PATNA, India, Nov. 24 -- Patna High Court issued the following judgment on Oct. 1:

Heard learned counsel for the parties.

2. Following reliefs are sought for in the present writ petition:

"For issuance of an appropriate writ (s) in the nature of Public Interest Litigation for direction to the respondents to remove the encroachment over the road from Momin Tola, Madarsa Chowk to Tilak Chowk (District Central Library) Situated at ward no. 23/24 in the light of the Government letter no. 05/1633, dated 08.04.2021 to grant any other relief(s) for which petitioner may found entitled in accordance with law."

3. It has been submitted on behalf of the petitioner that public land has been encroached by some local persons.

4. In view of the aforesaid, the petitioner is directed to make an appropriate representation before the competent authority under the provisions of the Bihar Public Land Encroachment Act, 1956, who shall consider the same and pass an appropriate order under Section 6 of the Act, preferably within a period of nine months from the date of filing of such representation, after giving opportunity of hearing to all the stakeholders.

5. With the aforesaid observations and directions, the present writ petition stands disposed of.
