PATNA, India, July 18 -- Patna High Court issued the following judgment on July 10:
Heard the parties.
2. The petitioner, who superannuated from the post of Upper Division Clerk long back in the year 1990, after rendering services of more than 33 years, has now been deprived from the revised pension and, as such, he is compelled to approach this Court by filing the present writ petition seeking a direction upon the respondent authorities to ensure payment of revised pension in terms of Letter No. 15/RV7041220159745/182212P1 dated 16.12.2020 issued under the signature of the Senior Accounts Officer, Accountant General ( A&E), Bihar, Patna.
3. It is the contention of the petitioner that the pension of the petitioner should be revised with effect from 01.04.2017, however, despite the order directing for revision of pension way back in the year 2020, he has not been allowed the revised pension and arrears thereof as yet.

A counter affidavit on behalf of the Accountant general came to be filed with categorical assertion that the revised pension authority has been issued as per the application of the petitioner but in the meanwhile Barh Treasury merged in Patna Treasury. Hence, vide letter No. 712 dated 27.07.2022, it has been informed to the Patna Treasury for making payment after getting revised authority. Copy of the revised authority is also placed on record as Anneuxre-2 to the writ petition.

Considering the limited grievance of the petitioner and the fact that the petitioner has been deprived from his revised pension since year 2017, this Court directs the District Treasury Officer, Patna Treasury, Patna to ensure payment of admissible revised pension after getting all the formalities done, preferably within a period of eight weeks from today.
6. It is needless to observe that the petitioner is an old hapless person superannuated long back in the year 1990 and he has been deprived from his revised pension since long, any deliberate delay in making payment of admissible revised pension shall be viewed seriously.
7. The writ petition stands disposed of with the aforesaid observation.
