PATNA, India, Oct. 24 -- Patna High Court issued the following judgment on Sept. 25:

Heard the parties.

2. The matter in hand, is in narrow compass to the extent of publication of final result of the petitioner, who had been allowed to participate in B.Tech (Mid Term as well as End Term) examination of VIIth Semester, pursuant to the order of this Court dated 15.02.2025.

3. This Court considering the predicament and cloud over the future prospect of the petitioner, who had been pursuing the course of B. Tech, directed the University and the College, in question, to allow the petitioner to participate in the VIIth Semester examination and accordingly the petitioner had participated in the said examination and later on he was allowed to participate in the VIIIth Semester examination, but now the result is pending, subject to the final outcome of the writ petition.

4. Learned Advocate for the respective parties have fairly submitted that some of the identical matters have come up for consideration before the learned Division Bench of this Court in L.P.A. No. 1164 of 2024, wherein considering the fact that the students were allowed to appear in the examination in pursuant to the interim order of the Court, the Respondent University has taken a generous decision to give concession to the students, who have already appeared in the examination and their results are pending subject to the final outcome of the writ petition.

Learned Advocate for the petitioner submitted that since the petitioner has appeared in VIIth semester pursuant to the interim order of this Court and further he has been allowed to participate in the VIIIth Semester examination, after attending the required classes, thus there is no impediment in declaration of his result, as with respect to other candidates, the results have already been declared. He thus submitted that if the result of the petitioner is not published, his entire career would be ruined and put to jeopardy.

6. Mr. S. S. Sundram, learned Advocate for the University/College has fairly submitted that once in pursuant to the order of the learned Division Bench concession has been given to the students of different faculties of the University, the respondent University and the College shall consider the case of the petitioner sympathetically.

Considering the fair submissions and also the fact that the petitioner had appeared in the examinations, in pursuant to the order of this Court, the writ petition stands disposed of with a direction to the Principal, Darbhanga College of Engineering, Darbhanga and the Registrar of the Bihar Engineering University to declare the result of the petitioner, as has been issued in favour of the other candidates, preferably within a period of four weeks from today.

8. The writ petition stands disposed of.
