ORISSA HIGH COURT ISSUES ORDER ON SURESH CHANDRA BEHERA V/S ARCHANA MOHANTY

CUTTACK, India, May 11 -- Orissa High Court issued the following order on April 9:

1. The matter has been listed under the caption:

"For referral to the Special Mediation Drive 2.0- Mediation for the Nation".

2. The writ application was filed in the year 2010 challenging the order dated 02.03.2010 passed by the learned Judge, Family Court, Rourkela in C.P. No.198 of 2009 rejecting the prayer for stay of the proceeding.

3. None appears for the Opp. Party.

4. By order dated 13.03.2026, the following was directed:

"5. The Registry shall also obtain instruction regarding the status of the C.P. No.198 of 2009 from the learned Judge, Family Court, Rourkela and status of the MAT case No.471 of 2008 then pending before the Court of learned Civil Judge (Senior Division), Puri from the Court in seisin of the matter.

5. It is submitted by learned counsel for the Petitioner Ms. Bose that she has contacted the Petitioner by sending letter through Speed Post with registration and proof of delivery. The tracking report shows that the letter has been received. But the Petitioner remains incommunicado. She, therefore, pleads lack of instruction. Memo of date is filed by the learned counsel for the Petitioner which states thus:

"That a letter has been sent to the Petitioner on 16.03.2026, and the same has been received by him. But he didn't respond to the same. Hence we have no instruction from the petitioner."

The memo shall be taken on record. Scanned copy be updated.

The letter from the learned Judge, Family Court, Rourkela dated 28.03.2026 addressed to the Registry pursuant to the order dated 13.03.2026 indicates that on 15.07.2022, judgment has been delivered in CP No.198 of 2009. The operative portion of the judgment is indicated in the letter: "Dismissed on contest without cost".

Pursuant to the order dated 13.03.2026, the learned Judge, Family Court, Puri has also intimated by letter dated 04.04.2026 that in CP No.93 of 2010 judgment has been pronounced by judgment dated 26.02.2011. The decree was signed and sealed on 07.03.2011.

7. In view of the above, nothing survives for adjudication.

8. The Writ Petition is disposed of.

Copy of this order shall be forwarded to the learned Judge, Family Court, Rourkela to be kept in the records of C.P. No.198 of 2009. Copy of this order shall also be forwarded to the learned Judge, Family Court, Puri to be kept in the records of C.P. No.93 of 2010.
