CUTTACK, India, Feb. 26 -- Orissa High Court issued the following order on Jan. 27:

1. Heard.

2. By judgment dated 27.12.2025 of the learned Special Judge (Vigilance), Balasore in T.R. Case No. 10 of 2010 (CIS No.272 of 2014) arising out of VGR No.53 of 2008 corresponding to Balasore Vigilance P.S. Case No.53 of 2008, the Appellant has been convicted for commission of offences under Section 13(1)(c) of the P.C. Act, punishable under Section 13(2) of the Act and sentenced to undergo R.I. for two years and to pay fine of Rs.50,000/- in default, to undergo R.I. for six months more; for commission of offence under Section 409 of the IPC and sentenced to undergo R.I. for three years and to pay fine of Rs.50,000/- in default, to undergo further R.I. for six months; for commission of offence under Section 467 of the IPC and sentenced to undergo R.I. for three years and to pay fine of Rs.50,000/- in default, to undergo further R.I. for six months; for commission of offence under Section 477-A of the IPC and sentenced to undergo R.I. for three years and to pay fine of Rs.50,000/- in default, to undergo further R.I. for six months. The sentences were directed to run concurrently.

4. Call for the scanned copy of the Trial Court Records.

5. List this case on 20.04.2026.

6. Mr. Sanjay Kumar Das, learned Standing Counsel (Vigilance) submits that he shall file appearance memo by 06.02.2026.

7. This is an application under Section 430 of BNSS for grant of bail during pendency of the appeal.

8. Learned counsel for the Appellant-Petitioner submits that the Appellant-Petitioner was on bail during trial and he has not misutilised his liberty.

9. Considering the sentence imposed and as the AppellantPetitioner was on bail during trial, I am inclined to allow the I.A.

10. The Appellant-Petitioner-Rabindra Kumar Aich, on surrendering before the learned trial Court within four weeks from today, shall be released on bail, pending disposal of the Criminal Appeal, on such terms and conditions as may be fixed by the learned Court.

11. This I.A. is disposed of.

12. This I.A. has been filed for staying realization of fine amount.

13. The Appellant-Petitioner shall deposit the fine amount in the learned trial Court within a period of four weeks from today. It shall be subject to result of the appeal.
