CUTTACK, India, April 27 -- Orissa High Court issued the following order on March 26:
1. Heard Mr. S. Mohanty, learned counsel for the petitioner.
2. Mr. T. Sahu, learned counsel appears for the opposite parties - Bank.
3. The grievance of the petitioner is that his vehicle bearing registration number OD-02-CT-2298 has been seized by the Bank for non-payment of the installments.
4. As seen from Annexure-3, a total outstanding of Rs.5,64,593.69 in respect of the loan taken by the petitioner for the vehicle is pending against her. As submitted by Mr. Sahu, an amount around Rs.75,000/- is due as on toady against the petitioner as per the terms of payment of the loan amount.
5. In the circumstances, the writ petition is disposed of permitting the petitioner to deposit the amount outstanding against her as on date as per the regular installments including other charges. In the event the amount is paid within a period of ten days from today, the vehicle in question may be released in favour of the petitioner subject to payment of regular EMI in future.
