CUTTACK, India, May 19 -- Orissa High Court issued the following order on April 17:

1. The Petitioner, in the present petition, seeks quashing of the FIR No.329 of 2021 dated 11.10.2021 corresponding to CT Case No.869 of 2021 pending before the learned JMFC, Balasore.

I. FACTUAL MATRIX OF THE CASE:

2. The brief facts of the case are as follows: i. The Petitioner is the mother of Opposite Party No.3. The Opposite Party No.2 and the Opposite Party No.3 got married each other on 04.02.2018 at Balasore under the Hindu Marriage Act, 1955.

ii. At the time of solemnization of the marriage, the Opposite Party No.2 was employed as Lecturer in the Government Polytechnic College, Balasore at Remuna where she continues to be employed even today. Similarly, the Opposite Party No.3 was employed as a Doctor at Kandhamal and is presently employed as a doctor at Kendrapara.

iii. Due to the said employment at different places and probably on account of staying away from each other, differences cropped up between the Opposite Party No.2 and the Opposite Party No.3.

iv. The differences between the Opposite Party No.2 and the Opposite Party No.3 soon took an ugly turn and manifested in the form of cruelty on account of which on 20.11.2020 the Opposite Party No.3 filed a case under Section 13(l)(ia) of the Hindu Marriage Act, 1955 in the Family Court at Cuttack.

v. The Opposite Party No.2 filed Transfer Petition No.16 of 2021 in this Court, and this Court vide Order dated 17.03.2021 directed the transfer of the above divorce proceedings from the Family Court at Cuttack to Family Court at Balasore.

vi. The Divorce Petition filed by Opposite Party No.2 was admitted by the Family Court at Balasore on 20.04.2021 and was numbered as C.P. 275 of 2021. The Family Court at Balasore sent the Opposite Party No.2 and the Opposite Party No.3 to mediation. On 04th October 2021 the mediation between the parties failed.

vii. The Opposite Party No.2 the very next day, i.e., 05.10.2021 filed DV Misc. Case No 150 of 2021 in the JMFC Court at Balasore under Section 12 of the Protection of Women from Domestic Violence Act 2005, wherein the Petitioner is arraigned as one of the Opposite Parties.

viii. The Opposite Party No.2 did not stop with the initiation of proceedings under the Protection of Women from Domestic Violence Act, but went ahead and lodged a Complaint dated 11.10.2021 with the Sadar Police Station making all sorts of allegations against the Petitioner. The allegations made by Opposite Party No.2 are general and sweeping in nature qua this Petitioner.
