CUTTACK, India, March 4 -- Orissa High Court issued the following order on Feb. 3:

1. This matter is taken up through Hybrid mode.

2. Heard the learned counsel for the Petitioner. Perused the CMP application as well as the prayer made therein.

3. On perusal of the impugned order dated 16.01.2026, it appears that the application of the Petitioner under Order-9 Rule13 read with Section 151 of C.P.C. has been dismissed only on the ground that the Petitioner has not taken any step for condonation of delay.

4. According to the learned counsel for the Petitioner, there was only five days delay.

5. In view of the aforesaid position, this Court is of the view that the matter requires further consideration after appearance of the Opposite Parties.

6. Hence, issue notice to the Opposite Party by Speed Post with A.D. by fixing a short returnable date. Requisites be filed within a week hence.

7. List this matter in the week commencing 16th March, 2026. I.A. No.213 of 2026

8. Heard the learned counsel for the Petitioner.

9. As an interim measure, it is directed that on an application being filed by the Petitioner before the learned executing court seeking adjournment of Execution Case No.01 of 2025, the learned executing court shall do well to adjourn the Execution Case for a further period of four weeks.
