PATNA, India, March 4 -- Patna High Court issued the following order on Jan. 2:
1. No one appears on behalf of the parties.
2. From perusal of the records, it appears that on several dates, i.e., on 13.11.2025 and 12.01.2026 and today also, nobody appears on behalf of the learned counsel for the appellant as well as learned counsel for the respondent. It also appears that on several occasions, i.e., on 01.09.2025, 13.10.2025, 27.11.2025, learned counsel for the appellant sought some adjournments and again he remain absented on the above dates.
3. On perusal of the records, it also appears that this First Appeal is of the year 2004 and the appellant is not arguing in the matter since last several dates and even today, on repeated calls, no one appears on behalf of the appellant as well as notices have already been issued upon the concerned respondents, so in these circumstances, the present First Appeal is dismissed for default under Order 41 Rule 17 of the Code of Civil Procedure.
