This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
Heard Mr. Bose, learned senior counsel for the Petitioner. Perused the CMP application as well as the prayer made therein.
By filing the present CMP application under Article 227 of the Constitution of India, the petitioner seeks to challenge order dated 15.09.2025 passed by the learned Civil Judge (Junior Division), Bhadrak in C.S. No. 1108 of 2024 whereby the learned trial Court has admitted the counter claim filed by the defendant without considering the objection raised by the plaintiff with regard to the violation on counter claim.
Learned counsel for the Petitioner at the outset contended that the counter claim which has been filed by the defendant in C.S. No. 1108 of 2024 is grossly undervalued.
