01. 1. This matter is taken up through Hybrid Arrangement (Virtual
/Physical Mode).
2. Heard learned counsel for the plaintiff-Petitioner. Perused
the application as well as the prayer made therein.
3. By filing the present application under Article 227 of the
Constitution of India, the Petitioner seeks to challenge orders under
Annexure-3 and 4 passed by the learned trial court as well as the
lower appellate court confirming the rejection of the prayer of the
Petitioner made under Order 39 Rule 1 and 2 of the CPC.
4. Learned counsel for the Petitioner at the outset contended
that the present application arises out of a suit for partition. He
further contended that during pendency of the suit, defendant
Nos.1 & 2 are making construction over the suit scheduled land in
excess of the share which is likely to be allotted in their favour in
the event such partition is decreed.
