This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
Heard learned counsel for the Petitioner. Perused the CMP application as well as the prayer made therein.
By filing the present CMP application under Article 227 of the Constitution of India, the Plaintiff in C.S. No. 140 of 2020, who is aged about 85 years according to the counsel for the Petitioner, has prayed for a direction to the learned Civil Judge (Junior Division), Basudevpur to conclude the trial in the suit as expeditiously as possible, keeping in view the advanced age of the plaintiff.
Learned counsel for the Petitioner at the outset contended that the plaintiff who was aged about 80 years at the time of filing of the suit is 85 years now. Although the suit was filed in the year 2020, the same is still pending for trial.
