SHILLONG, India, March 8 -- Meghalaya High Court issued the following judgment/order on Feb. 6:

Today when the matter is taken up, Ms. I.Lyngwa, learned GA for the respondents submits that nothing survives for consideration in view of the fact that the FIR filed by the petitioner has been duly registered. She therefore, prays that the matter may be closed and disposed of.

Mr. K.C.Gautam, learned counsel for the petitioner has vehemently opposed this submission and has argued that, firstly, the respondent No. 5 though on receipt of notice, has failed to appear before this Court. He further submits that the Police have merely registered the FIR and the case has not progressed, inasmuch as, the trespassers are still roaming around scot-free and are in occupation of a portion of the premises of the writ petitioner. He therefore, prays for further directions to ensure that the official respondents cause immediate action on the cases registered.

This Court on hearing the learned counsel for the petitioner, though noting that the prayer in the writ petition is for directions to register the FIR filed by the petitioner, however, in view of the submissions made, directs that a status report be furnished by the Officer In-charge, Khanapara Police Station within ten days from today as to the steps taken with regard to the cases registered.
