IMPHAL, India, Feb. 9 -- Manipur High Court issued the following order on Jan. 7:
[1] Heard Mr. N. Ibotombi, learned senior counsel appearing along with Mr. N. Nabakishwor and Mr. N. Leo, learned counsel for the petitioners.
[2] By the present petition, the petitioners are challenging the impugned order dated 13.11.2025 passed by the Ld. District Judge, Imphal West in Misc. Civil Appeal No. 9 of 2025.
[3] It is stated that the petitioners are plaintiff in O.S. No. 20 of 2020 pending before the Ld. Civil Judge (Jr. Division), imphal West-I and vide order dated 31.07.2025 in Judl. Misc. No. 97 of 2020 [Ref: O.S. No. 20 of 2020], the Trial Court passed an order of maintaining status quo as on date between the parties until vacated.
[4] The respondents/defendants herein challenged the order dated 31.07.2025 of maintaining status quo and by the impugned order dated 13.11.2025, the Ld. District Judge set aside the same as there is no prima facie case in favour of the plaintiffs/appellants herein.
[5] This Court is of the view that since the impugned order is 13.11.2025, the matter may be listed before regular bench.
[6] However, Mr. N. Ibotombi, learned senior counsel for the petitioners, submits that taking advantage of the impugned order, the defendants/respondents have started construction upon the suit land and it is prayed that till listing of the case before the appropriate bench, there may be stayed of further construction.
[7] Accordingly, list this case before the appropriate roster bench on 12.01.2026. Till then, any construction of the disputed suit land be suspended.
[8] Furnish a copy of this order to the learned counsel appearing for all the parties.
