IMPHAL, India, April 26 -- Manipur High Court issued the following order on March 26:
Heard Mr.Ajoy Pebam, learned counsel for the petitioner and Mr.H.Samarjit, learned PP assisted by Ms.R.K.Emily, learned Dy. Government Advocate for the State.
The main prayer in the petition is for directing respondent No.2, the Director General of Police, Manipur to appoint any officer not below the rank of Sub Divisional Police Officer (SDPO) to investigate FIR No.13 (03) 2022 SGT-PS u/s 351/307/34 IPC as the accused is an elected representative and an officer below the rank of SDPO cannot investigate the matter. The present Investigating Officer is a Sub-Inspector of Police.
Mr.H.Samarjit, learned PP submits that the petition may be disposed of by issuing innocuous order directing respondent No.2 to appoint an Investigating Officer in the rank of SDPO.
This Court has considered the materials on record and submissions made at the Bar. The cril petition is disposed of by directing respondent No.2, the Director General of Police, Manipur to refer the investigation to a police officer not below the rank of SDPO as expeditiously as possible.
With this observation, the cril petition is disposed of. Misc case is also disposed of.
Registry is directed to send a copy of this order to the DGP, Manipur for information.
