JABALPUR, India, June 8 -- Madhya Pradesh High Court issued the following judgment/order on May 8:
The present petition has been filed seeking the following reliefs:
7.1 That this Hon'ble Court may kindly be pleased to issue a writ of certiorari and set aside the impugned notice dated 27.02.2018 in the interest of justice.
7.2 That this Hon'ble Court may kindly be pleased to command the respondents not to take any coercive steps against the petitioners.
7.3 That any other relief which this Hon'ble Court may deem just and proper in the facts and circumstances of the case may kindly be issued in favour of the petitioners along with costs of the petition.
2. As stated in the present petition that the construction, which is alleged to be not legally and validly raised on the land in question, for which, action under Section 320 of the Municipal Corporation Act, 1956 is to be taken. The respondents are proposing the action against the petitioner under those provisions.
3. We hereby dispose of the present petition directing the Municipal Corporation while taking action under Section 322 of the Municipal Corporation Act, 1956, the opportunity of hearing shall be given to the petitioner.
4. The petition is accordingly, disposed of.
5. Till the decision is taken, the show cause notice dated 04/03/2025 shall remain stayed.
