JABALPUR, India, Aug. 21 -- Madhya Pradesh High Court issued the following judgment/order on JUDGMENT/ORDER/RELEASE on July 21:

IA No.13599 of 2025

This is an application for condonation of delay of 209 days in filing the present MCC.

For the reasons stated in the application, delay in filing the MCC is condoned and IA stands allowed.

MCC No.2270 of 2025

Applicant seeks restoration of W.A.No.2107/2023, which was dismissed for non-compliance of common conditional order dated 08.11.2024.

The counsel for applicant/State submits that d ue to inadvertence, applicant had no knowledge about passing of the common conditional order, because of which, the applicant could not cure the default in time. Therefore, the said mistake, being unintentional and bonafide, deserves to be condoned by this Hon'ble Court. He further submits that in case if the aforesaid writ appeal is not heard on its own merits, the same will cause irreparable injury to the State Government as public land is under dispute in the present main matter. Therefore, in view of the above circumstances it would be appropriate in the interest of justice to restore W.A.No.2107/2023 to its original number for hearing.

In view of the above submissions made by the counsel for applicant, W.A.No.2107/2023 is restored to its original number.

Applicant shall cure the defects within one week, if any.

Accordingly, the MCC is disposed of.

Registry is directed to place the copy of this order along with the record of W.A.No.2107/2023.
