JABALPUR, India, June 8 -- Madhya Pradesh High Court issued the following judgment/order on May 8:
The appellant who is appearing present in person submits that writ petitioner i.e. Krishna Chand Kurele (Gupta) had filed the W.P. No.29337/2022 which was dismissed vide order dated 27.02.2024. Against which, present writ appeal has been filed. However, in the cause title, the writ petitioner Krishan Chand Kurela Gupta was mentioned as respondent No.1. It appears that due to clerical mistake, the name of Ashok Kumar has been mentioned as appellant. The appeal is stated to be filed actually by Krishan Chand Kurele as Vakalatnama and affidavit in support are also executed by him.
In the present appeal, an IA. No.2868/2025 is filed seeking withdrawal of writ appeal on 13.02.2025 with liberty to file duly constituted writ appeal by the writ petitioner Krishan Chand Kurele Gupta who died on 07.04.2025. Thereafter, an application for bringing the legal heirs has been filed by the legal heirs of writ petitioner namely Sudheer Gupta and Nitesh Gupta.
Prayer is allowed.
Accordingly, writ appeal is dismissed as withdrawn with liberty as prayed.
