JABALPUR, India, Dec. 8 -- Madhya Pradesh High Court issued the following judgment/order on Nov. 7:

Petitioner is aggrieved by the order dated 30.10.2025, whereby the interim prayer of the petitioner seeking stay on the transfer has been declined holding that the petitioner can come back to defend himself in the criminal case and the respondents have agreed to grant leave as per availability.

Learned counsel for petitioner submits that petitioner has been implicated in a false case while he was performing his official duties and most of the prosecution witnesses in the trial have already been examined and the trial is likely to conclude. He submits that Union of India itself has filed a petition challenging the registration of criminal case against the petitioner on the ground that same was false implication.

Since the stand of Union of India itself while challenging the criminal case registered against the petitioner was that petitioner was implicated in the said case falsely while performing his official duties, we disposed of this writ petition directing the respondents to grant leave to the petitioner for attending the criminal case as also the TA and DA for the said purpose.

The leave shall not be deducted from the account of petitioner.

Petition is accordingly disposed of in the above terms.
