JABALPUR, India, Dec. 8 -- Madhya Pradesh High Court issued the following judgment/order on Nov. 7:

1. This is an application on behalf of petitioner seeking restoration of the writ appeal that has been dismissed in default on 26.08.2025.

2. It is contended by learned counsel for petitioner that he had appeared on first call and after some arguments he had taken time to seek instructions and matter was passed over. Thereafter, the other matters were being called and Court was taking up other matters and he left the Court premises at 04:15 pm, believing that his matter would not be reached. However, on second call matter was taken up and it was dismissed in default.

3. We note that the petition is supported by an affidavit of counsel himself and the petition has been filed within 15 days of it being dismissed in default.

4. In view of the above, this petition is allowed. The Writ Appeal No.2091 of 2025 is restored to its original number.

5. Registry is directed to place the copy of this order alongwith the record of W.A No.2091 of 2025. Accordingly, the MCC is disposed of.
