JABALPUR, India, March 8 -- Madhya Pradesh High Court issued the following judgment/order on Feb. 5:
I.A. No. 25686/2025;
This is an application seeking condonation of delay.
Learned counsel for the petitioner submits that petitioner was under an impression that the defects have been cured by the clerk and as such did not notice the matter when the matter was listed for non compliance. The application is supported by an affidavit of the counsel for the petitioner.
For the reasons stated in the application, IA No.25686/2025 is allowed. The delay in filing the petition is condoned.
MCC No. 4553 of 2025;
Petition has been dismissed for not complying with the common conditional order.
As per the petitioner, the counsel was under an impression that the clerk had already cured the defaults. It is stated that the counsel did not notice that the defaults had not been cured and missed the matter when the same was listed for non complying with the common conditional order. The petition is supported by the affidavit of the advocate.
In view of the above, petition is allowed. WP No.6869/2024 is restored to its original number. Copy of this order be placed in the writ petition.
