JABALPUR, India, Aug. 2 -- Madhya Pradesh High Court issued the following judgment/order on July 1:
Learned counsel for petitioner seeks leave to withdraw the petition reserving the right of the petitioner to file a second appeal in terms of Section 58 of the Real Estate (Regulation and Development) Act, 2016 (for short "the Act").
In view of the above, the petition is dismissed as withdrawn with liberty to the petitioner to assail the same in terms of Section 58 of the Act.
All rights and contentions of the parties are reserved.
The interim order dated 08.11.2024 shall continue for a period of 15 days from today or till the time the appeal is filed and listed for consideration before the Court, whichever is earlier.
It is clarified that on expiry of the period of 15 days or on listing of the appeal, interim protection extended herein shall automatically lapse.
