JABALPUR, India, March 8 -- Madhya Pradesh High Court issued the following judgment/order on Feb. 5:

I.A. No.24036/2025;

This is an application seeking condonation of delay in filing the restoration application.

Learned counsel for the petitioner submits that the application has been filed as the Registry opined that there was a delay of 60 days in filing the petition. He submits that though a peremptory order was passed on 14.08.2025, the consequential order was passed only on 06.11.2025 and subject petition has been filed on 13.11.2025 within seven days.

In view of the above, we hold that the petition has been filed within time from the order dismissing the writ appeal, consequently the application is disposed off.

Petitioner had challenged order dated 01.07.2024. Certain defects has been pointed out by the Registry.

As per the petitioner the clerk of the counsel was unwell and as such could not cure the defects within time. It is stated that counsel was unaware of the mistake that happened on account of illness of the Clerk.

We note that the petition is supported by an affidavit of counsel for the petitioner.

In view of the above, the petition is allowed.

The Writ appeal No.1100/2025 is restored to its original number. Appellant shall cure the defects now within a period of one week. On appellant curing defects, the appeal shall be listed before the concerned roster bench. Copy of this order be placed in the record of writ appeal.
