JABALPUR, India, Feb. 9 -- Madhya Pradesh High Court issued the following Jan. 9:
I.A. No.12340/2025, an application for condonation of delay in filing the review petition.
The petitioner had earlier approached this Court by way of a Misc. Civil Case No.2486/2024 which was subsequently withdrawn with liberty to file a review petition on 10.05.2025 and the present petition has been filed immediately thereafter.
Learned counsel for the respondents submits that without prejudice to the rights and contention, they have no objection for the delay being condoned.
In view of above, the delay in filing the review petition is condoned.
By this petition, petitioners seek review of order dated 08.05.2024 passed in W.P. No.12094/2023. It is contended that the said writ petition was tagged alongwith a batch of matters even though it was not connected with the other cases. It is stated that the dispute in the subject writ petition was with regard to reduction made on account of certain departmental enquiry whereas the other cases pertain to recovery of amount which was over paid.
Issue notice.
Notice is accepted by learned counsel appearing for the respondent No.1 as also respondent No.2.
Learned counsel for the respondents fairly states that the issue involved in the present petition was not involved with the other cases which was disposed of by a common order dated 08.05.2024.
In view of the above, petition is allowed. The impugned order dated 08.05.2024 insofar as it pertain to W.P. No.12094/2023 is set aside. W.P. No.12094/2023 is restored to its original number.
Copy of this order be placed in the record of W.P. No.12094/2023.
