JABALPUR, India, March 8 -- Madhya Pradesh High Court issued the following judgment/order on Feb. 6:

Petitioner impugns circular dated 09.05.2022 as well as demand notice dated 18.11.2025, whereby the petitioner has been directed to pay dead rent. The challenge is on the ground that no mining operations could be undertaken due to lack of Bhupravesh Permission and Environmental Clearance.

The issue raised by the petitioner is squarely covered by the judgment of a co-ordinate Bench of this Court dated 28.01.2026 passed in W.P.No.3601 of 2021 ( title Madhya Pradesh Bricks Company Ltd. Vs. State of Madhya Pradesh and Others and other connected petitions), wherein the co-ordinate Bench has categorically held that the lessee is liable to pay dead rent irrespective of whether the lease deed is operational or not. Since the case of the petitioner is squarely covered by the judgment of the co-ordinate Bench dated 28.01.2026 in M.P. Bricks Company Ltd. (supra), the petition is dismissed in terms of the said judgment.

Copy of the judgment dated 18.01.2026 passed in W.P.No.3601 of 2021 shall be appended by the Registry to this order.
