JABALPUR, India, Feb. 14 -- Madhya Pradesh High Court issued the following Jan. 12:

Appellant impugns order dated 08.03.2022 whereby the writ petition filed by respondent No.6 was allowed holding that respondent no.6 was erroneously denying to pay retiral dues on account of the fault of the Treasury Officer. Appellant was the then Treasury Officer and in pursuant to the said order, action is proposed to be taken against the appellant.

Learned counsel for the appellant submits that appellant had taken all steps bonafidely and discharged his official duties and as such cannot be made personally liable for any delay in payment of the retiral dues. She, however, prays leave to withdraw the appeal reserving the rights of the appellant to raise all permissible defenses as also to contest the direction that Treasury Officer is liable to pay/deposit entire retiral dues.

However, the direction in order dated 08.03.2022 that respondents No.2 and 3 shall pay the entire retiral dues will not come in the way of the defense to be raised by the appellant in those proceedings.

In view of above, the appeal is dismissed as withdrawn.
