JABALPUR, India, Dec. 8 -- Madhya Pradesh High Court issued the following judgment/order on Nov. 7:

IA No.19164 of 2025

This is an application for condonation of delay of 142 days in filing the present MCC.

For the reasons stated in the application, delay in filing the MCC is condoned and IA stands allowed.

MCC No.3320 of 2025

Petitioner seeks restoration of W.P.No.18255 of 2023, which was dismissed for non-compliance of common conditional order dated 18.12.2024.

The counsel for petitioner submits that writ petition was dismissed for non-complying the common conditional order. He submits that due to the mistake of earlier counsel, the default pointed out by the Registry of this Hon'ble Court has not been cured on time and matter of the petitioner was dismissed on 06.02.2025 for non compliance of court order dated 18.12.2024. When the petitioner has seen the case status of dismissal of petition it was found that the matter has already been dismissed for noncompliance of court order for removing default. Therefore, in view of the above circumstances it would be appropriate in the interest of justice to restore W.P.No.18255 of 2023 to its original number for hearing.

In view of the above submissions made by the counsel for petitioner, this petition is allowed and W.P.No.18255 of 2023 is restored to its original number.

Petitioner shall cure the defects within one week, if any.

Accordingly, the MCC is disposed of.

Registry is directed to place the copy of this order along with the record of W.P.No.18255 of 2023.
