JABALPUR, India, Nov. 27 -- Madhya Pradesh High Court issued the following judgment/order on Oct. 29:
1. These petitions impugn action of the respondents in demanding alleged remaining fees from the petitioners' college on the enhanced seats.
2. Learned counsel appearing for the petitioners College as well as Madhya Pradesh Medical Science University submit that in a similar circumstances by order dated 31.08.2024 in Writ Petition No.25783 of 2024 (titled Pratyash College of Paramedical Run by Dr. Mukesh Giri Goswami Shekshanik and Charitable Society and Others Vs. State of M.P. & Others), a Division Bench of the Indore Bench has permitted the students of the said college to be permitted to participate in the examination by issuing enrollment numbers forthwith subject to depositing of the demanded amount in two installments.
3. It is agreed that similar order be passed in present case also on the petitioners depositing the balance fees as demanded by the respondents university in two installments i.e. 50% on or before 28.11.2025 and the balance 50% on or before 31st January, 2026. On the petitioners' institute depositing 50% of the amount, the students would be permitted to participate in the examination by issuing enrollment numbers. However, the result of the students shall not be declared till the time the entire arrears are deposited by the petitioners.
4. Accordingly, petition is disposed of in the above consensual terms.
