JABALPUR, India, Oct. 16 -- Madhya Pradesh High Court issued the following judgment on Sept. 15:

1. Subject petition has been filed by the petitioner styled as Public Interest Litigation. It is alleged that the building constructed by respondent No.9 is unsafe for running a school.

2. We note that petitioner and respondent No.9 are real brothers. Subject PIL seems to be actuated on account of a personal family dispute. Even otherwise the photographs placed on record do not show that the building is in any manner unsafe.

3. The contention of the learned counsel for the petitioner is that the property has been misused as a school and action has already been initiated by the Municipal corporation.

4. Subject PIL appears to be motivated and apparently there is no material placed on record to show that the building is unsafe for being run as a school, we are not inclined to issue notice.

5. Petition is accordingly, dismissed.
