JABALPUR, India, Nov. 16 -- Madhya Pradesh High Court issued the following judgment/order on Oct. 17:

IA No.16789 of 2025

This is an application for condonation of delay of 244 days in filing the present MCC.

For the reasons stated in the application, delay in filing the MCC is condoned and IA stands allowed.

MCC No.2821 of 2025

Applicant seeks restoration of W.A.No.2205/2023, which was dismissed for non compliance of common conditional order.

Learned counsel for the applicant submits that the earlier counsel has not intimated to the authority and due to lack of knowledge and in mean time the Panel Advocate of Union of India has been changed and present counsel has been appointed in the instant matter and he has filed Vakalatnama on 26.6.2025, and matter was listed before Registrar on 28.07.2025, then it came into knowledge of present counsel that a Peremptory order was passed on 08.11.2024 hence in view of aforesaid reason the office objection/default could not be cured within time and same is bonafide hence application for restoration is liable to be allowed. He further submits that the reason for noncompliance of Peremptory order is bonafide and not deliberate. If petition would not be restored the applicant would suffer irreparable loss.

In view of the above submissions made by the counsel for applicant, Registry is directed to restore W.A. No. 2205/2023 to its original number.

Applicant shall cure the defects within one week, if any.

Accordingly, the MCC is disposed of.

Registry is directed to place the copy of this order along with the record of W.A.No.2205/2023.
