JABALPUR, India, Feb. 19 -- Madhya Pradesh High Court issued the following judgment/order on Jan. 16:
I.A. No.1207 of 2026 This is an application for condonation of delay. There is no delay in filing the MCC. Accordingly, the application is disposed of.
M.C.C. No.144 of 2026 Petitioners seek restoration of M.C.C.No.2138 of 2025, which was dismissed for non-compliance of common conditional order dated 14.10.2025.
Learned counsel for petitioners submits that petitioners filed W.P.No.14409/2024 which was dismissed due to peremptory order dated 05.11.2024 and for restoration of W.P.No.14409/2024, petitioners have filed M.C.C. No.2138/2025 wherein certain defects were pointed out by the Registry of this Court and vide common conditional order dated 14.10.2025, petitioners were directed to make good the default of filing the application for condonation of delay within a period of six weeks. It is submitted by learned counsel that due to procedural and administrative requirement, the affidavit was made available to him on 04.01.2026 and the same was filed on 05.01.2026 in M.C.C.No.2138/2025 and since the same was filed belatedly, the M.C.C. was dismissed on 06.01.2026.
Learned counsel for the petitioners further submits that the mistake was bonafide in nature and not intentional therefore, MCC No.2138/2025 may be restored to its original number. .
In view of the above submissions made by the counsel for petitioners, M.C.C.No.2138/2025 is restored to its original number.
Petitioner shall cure the defects within one week, if any.
Accordingly, the present MCC is disposed of.
Registry is directed to place the copy of this order in M.C.C. No.2138/2025.
