JABALPUR, India, May 1 -- Madhya Pradesh High Court issued the following judgment/order on March 31:
1. Learned counsel for the appellants submits that appellants have subsequently revoked the suspension of the respondent. He submits that the concerns of the State is that the observations in the impugned order dated 07.05.2025 are likely to prejudice the merits of the inquiry which is pending against the respondent.
2. The apprehension expressed by the learned counsel for the appellant is misplaced for the reasons that the writ Court has only considered the order of suspension and any observation contained in the said order is prima facie and will have no bearing on the merits of the inquiry that is pending against the respondent or to the prejudice of either the petitioner or the respondent.
3. In view of the above, the appeal is disposed of. Needless to say that departmental inquiry shall be decided on the basis of the material available in inquiry proceedings. This Court has neither considered nor commented on the merits of the contention of either party.
All rights and contentions of the parties in the departmental enquiry are reserved.
