JABALPUR, India, Jan. 20 -- Madhya Pradesh High Court issued the following judgment/order on Dec. 19:

Petitioner impugns notice dated 04.12.2025, whereby in accordance with article 31.1.2 of the concession agreement executed between the parties, a notice of intention to issue termination notice is issued to the petitioner.

Learned counsel for the petitioner submits that in terms of the said notice wherein 15 days time was granted to the petitioner to respond, petitioner has given a response on 18.12.2025.

Learned Advocate General appearing for the respondents on advance notice submits that the response is under active consideration of the competent authority and an appropriate view in terms of the concession agreement shall be taken on the response.

In view of above, learned counsel for the petitioner seeks leave to withdraw the petition. However, prays that an opportunity of hearing be given to the petitioner by the competent authority.

In view of above, petition is dismissed as withdrawn and keeping in view the peculiar facts and circumstance of the case, the competent authority is directed to give an audience to the petitioner before taking a final decision on the response given by the petitioner.

It is clarified that this Court has neither considered nor commented on the merits of the contention of either party.

Learned Advocate General on instructions states that the petitioner should appear before Technical Advisor/ENC, MPRDC, Bhopal on 22.12.2025 at 11:30 A.M. for the purposes of an audience.

It is clarified that petitioner shall avail of the opportunity and no further opportunity shall be given to the petitioner.

The petition is accordingly dismissed as withdrawn in the aforesaid terms.
