JABALPUR, India, Nov. 24 -- Madhya Pradesh High Court issued the following judgment/order on Oct. 28:

Learned counsel appearing for the respondents raises a preliminary objection with regard to maintainability of the writ petition. He submits that the remedy of the petitioner is to challenge the award passed by the Collector in terms of Section 3G(5) of the National Highways Act, 1956.

Faced with the objection, learned counsel for the petitioner seeks leave to withdraw the petition reserving the right of the petitioner to initiate appropriate proceedings under Section 3G(6) of the National Highways Act, 1956.

The petition is dismissed as withdrawn with the liberty as prayed for.

All rights and contentions of the parties are reserved.
