JABALPUR, India, Oct. 21 -- Madhya Pradesh High Court issued the following order on Sept. 22:
1. Appellant impugns transfer order dated 16.06.2025, whereby appellant has been transferred from GPS Chapara Tola Dhawaiya to GMS Bhopar. Learned counsel for appellant submits that the parents of the appellant are aged and suffering from several ailments. She submits that the appellant has given a representation particularly, on the fact that his mother is bedridden and is seriously unwell and there is no one else to look after her, except the appellant.
2. Learned counsel for appellant submits that in similar circumstances the writ court has directed the respondents to consider the representation prior to giving effect to the posting order, however in the case of appellant similar relief has not been granted.
3. Issue notice.
4. Notice is accepted by learned counsel appearing for respondents/State.
5. Perusal of the medical documents of the mother of the appellant shows that she is suffering from several ailments even the father of the appellant is aged. In the peculiar facts of the case, we are of the view that respondent should consider the representation of the appellant prior to giving effect to the posting order.
6. In view of the above, this appeal is allowed. Respondents are directed to decide the representation of the appellant within a period of 30 days from today and till the representation is decided the posting order shall not be given effect and the same thereafter shall be given effect subject to the outcome of the representation.
7. it is clarified that this court has neither considered nor commented on the merits of the contentions of either party. Respondents shall decide the representation in accordance with law, however keeping in view the medical condition of the parents of the appellant. Appellant shall be permitted to join at the original place of posting and continue till the representation is decided.
