JABALPUR, India, Feb. 25 -- Madhya Pradesh High Court issued the following judgment/order on Jan. 27:

Learned counsel for the petitioner submits that though petitioner has filed an objection to the award seeking enhancement, however prays that the admitted amount assessed and deposited with the Land Acquisition Officer be disbursed to the petitioner.

In view of the above limited prayer, this petition is disposed off directing the petitioner to approach the Land Acquisition Officer and to complete all the requisite formalities and on completion of the formalities, the admitted assessed amount be disbursed to the petitioner within a period of 30 days of completion of formalities. It is clarified that this would be without prejudice to the claim of enhancement filed by the petitioner.

Further, it is noticed that respondent/ NHAI had taken possession of excess land for the purpose of construction of High Way. In Contempt petition Civil No.815/2022, National Highway Authority of India filed an affidavit stating that they have no requirement of the excess land and stated that the excess land had already been returned to the petitioner and as such possession was never taken from the petitioner.

Learned counsel for the petitioner submits that though possession is still with the petitioner, however in the records of NHAI, land is still be shown as acquired land. The respondent NHAI is directed to verify its record and correct the records in respect of the excess land which has been referred to in contempt petition Civil No.815/2022.
