JABALPUR, India, Nov. 22 -- Madhya Pradesh High Court issued the following judgment/order on Oct. 27:

This is an application for condonation of delay of 125 days in filing the present MCC.

For the reasons stated in the application, delay in filing the MCC is condoned and IA stands allowed.

M.C.C. No.2170 of 2025

Petitioner seeks restoration of W.P.No.26720/2024, which was dismissed for non-compliance of common conditional order dated 21.01.2025.

The counsel for petitioner submits that the said writ petition came up for hearing on 06.11.2024 in default. The Court passed preemptory order for removing the default but the previous counsel failed to remove the default, therefore, said writ petition was dismissed in default due to common conditional order dated 21.01.2025. He further submits that when the petitioner contacted from the counsel in the month of May 2025 then he came to know that the said writ petition has been dismissed in default. Thereafter, he engaged another counsel and filed this restoration application. Therefore, in view of the above circumstances it would be appropriate in the interest of justice to restore W.P.No.26720/2024 to its original number for hearing.

In view of the above submissions made by the counsel for petitioner, W.P.No.26720/2024 is restored to its original number.

Accordingly, the MCC is disposed of.

Registry is directed to place the copy of this order along with the record of W.P.No.26720/2024 and list W.P.No.26720/2024 on 29.10.2025.
