JABALPUR, India, May 1 -- Madhya Pradesh High Court issued the following judgment/order on March 31:

I.A. No.4653/2026

This is an application for condonation of delay of 14 days in filing the present petition.

For the reasons stated in the application, delay in filing the petition is condoned and IA stands allowed.

MCC No.661/2026

1. Petitioner seeks restoration of W.A. No.2341/2025 which was dismissed for non-compliance of peremptory order dated 27.11.2025.

2. Learned counsel for the petitioner submits that the due to the fault of clerk of arguing counsel, the default could not be removed within the stipulated time and therefore, the appeal was dismissed by common conditional order dated 27.11.2025. He submits that the mistake is bonafide in nature and not intentional and simply a mistake of office clerk. Therefore, in view of the above circumstances, W.A. No.2341/2025 deserves to be restored to its original number for hearing.

3. In view of the averments made in the petition, W.A. No.2341/2025 is restored to its original number.

4. Accordingly, the MCC is allowed. 5. Registry is directed to place copy of this order alongwith the record of W.A. No.2341/2025.
