JABALPUR, India, Nov. 16 -- Madhya Pradesh High Court issued the following judgment/order on Oct. 16:
Appellant impugns order dated 10.09.2025, whereby the writ petition filed by the respondent No.1 impugning his transfer has been disposed of directing the respondent No.1 to first join the place of posting and then directing the appellant to consider as to whether respondent could be posted at any place near to his Home District in any of the 14 identified financially weak banks or other banks.
Learned counsel for appellant fairly states that respondent No.1 has already joined the new place of posting. He however submits that the respondent No.1 could not be directed to be posted near his Home District.
We note that learned Single Judge has merely directed the appellant to consider as to whether the respondent No.1 could be posted to any place near his home district. There is no mandate to the appellant to post him near his own district. The appellant can always consider the same keeping in view the administrative exigency, however, in case any such position is available and it is administratively feasible to post the respondent no.1, the appellant has to comply the order of learned Single Judge. In any event, respondent No.1 has already acted upon the order and joined the new place of posting.
We note that the learned Single Judge has granted 30 days time to the appellant to consider the posting of the respondent No.1. He joined the place of posting on 15.09.2025 and 30 days period is already over.
In that view of the matter, we direct the appellant to comply with the order of learned Single Judge within a period of two weeks from today.
Appeal is disposed of in the above terms.
