JABALPUR, India, Feb. 25 -- Madhya Pradesh High Court issued the following judgment/order on Jan. 27:
Learned counsel for the respondent No.4 i.e. Bid Inviting Authority states that the tender has been cancelled and further steps are yet to be decided by the Tender Inviting Authority. He seeks leave to file affidavit.
Permission is granted. The affidavit be taken on record.
He submits that since the tender has been cancelled the petition has become infructuous.
In view of the above, learned counsel for the petitioner seeks leave to withdraw the petition reserving the right of the petitioner to approach afresh, if need so arises.
Petition is dismissed as withdrawn.
All rights and contentions of parties are reserved.
