JABALPUR, India, March 11 -- Madhya Pradesh High Court issued the following judgment/order on Feb. 9:

1. The appellant impugns order dated 13.11.2025, whereby the writ petition filed by the appellant has been dismissed.

2. The appellant is a guest faculty and has now been declared as "fallen out" on account of regular posting in respective government college. The factual position was that no guest faculty was permitted to be replaced by a guest faculty and was permitted to be replaced by a regularly appointed faculty appointed either on regular basis or by transfer of regular employees.

3. In the case of the appellant, the regular employee has replaced the appellant and accordingly the appellant has been declared as "fallen out". The State Government has already taken a decision that all "fallen out" guest faculty would be allotted to the Government Colleges against sanctioned post by mapping through IFMIS and said process shall be undertaken twice a month. Since the appellant has been replaced by regularly appointed faculty, he can not have a grievance against the replacement. In so far as his rights are concerned, he has given an opportunity by the State Government and as also reiterated by the Writ Court that he has two occasions to submit his options between 1st to 3rd and 15th to 18th in each month for being allotted government colleges against vacant sanctioned post by mapping through IFMIS.

4. We find no infirmity in the view taken by the learned Single Judge or any merit in the appeal. The appeal is accordingly, dismissed.
