JABALPUR, India, Aug. 19 -- Madhya Pradesh High Court issued the following judgment/order on July 21:

I.A. No.8748/2025:

This is an application seeking condondation of delay in filing the appeal. There is a delay of 1035 days in filing the appeal.

It is contended that there was a error in the original impugned judgment dated 19.4.2022 and thereafter petitioner had filed a review petition, which was disposed of on 7.3.2025 and from the said date the appeal is within time.

Keeping in view the facts and circumstances of the case, I.A. is allowed. The delay in filing the appeal is condoned.

W.A. No.1528/2025:

Appellant impugns order dated 19.4.2025 read with order dated 7.3.2025 passed in review petition to the extent that appellant had been directed to surrender his licence considering the amended provisions of Arms Act, 1959 and then to apply for a licence for the two weapons left behind by his father.

Learned counsel for the appellant submits that appellant already possess a licence for a .315 bore gun and intends to add the revolver left behind by his father on his licence.

The impugned order has been passed on the premise that Section 3(2) of the Arms Act, 1959 was amended in 2019 to the effect that a person cannot possess more than two fire arms at any given point of time.

The case of the petitioner is that petitioner intends to transfer the revolver left behind by his father on his own licence along with the existing licence of .315 bore guns that he possess. Petitioner contends that in so far 12 bore guns left behind by his father, he does not intents to posses the same, and same has already been transferred to another family member.

In view of the above, this petition is disposed of directing the State to consider the request of the petitioner to include the revolver left behind by his father on his existing licence in accordance with the rules. along with .315 bore gun licence.

The petition is accordingly disposed of in the above terms.

Petitioner is permitted to move an application within one week and thereafter the competent authority shall consider the same as expeditiously as possible.
