JABALPUR, India, Nov. 22 -- Madhya Pradesh High Court issued the following judgment/order on Oct. 27:
1. Learned counsel for the petitioner submits that after filing of the petition, the order passed by the Collector u/S 14 of the SARFAESI Act has been complied with.
2. Learned counsel for the respondents No.4 & 5 submits that since there was mandatory direction issued by order dated 09.10.2025, the possession was forcibly taken from the respondents No.4 & 5. He further submits that he had approached the Debt Recovery Tribunal by filing application for interim prayer. However, the application was not entertained in view of the mandatory direction issued by this Court on 09.10.2025. He prays that liberty be granted to the Debt Recovery Tribunal to proceed further.
3. Learned counsel for the petitioner submits that since possession has been handed over, he does not wish to press the petition any further.
4. In view of above, petition is dismissed as withdrawn. All rights and contentions of the parties are reserved. It would be open to the Debt Recovery Tribunal to consider the applications filed by respondents No.4 and 5 in accordance with law without being influenced by anything stated on merits and the orders passed in this petition.
