JABALPUR, India, March 19 -- Madhya Pradesh High Court issued the following judgment/order on Feb. 17:
1. Petitioner seeks direction to the respondents for relocation of the liquor shop which is allegedly situated near the temple, Mosque and Buddha Vihar. Learned counsel for the petitioner submits that the said shop is located within the prohibited distance as stipulated by the Excise Policy.
2. This contention is disputed by Mr. Swapnil Ganguly, learned Deputy Advocate General appearing for respondents/State. He submits that in all cases due consideration is given to the Excise Policy and it is ensured that no liquor vend is opened contrary to the Excise Policy. He further states that the licence of the current shop is to expire on 31st March, 2026 and fresh Excise Policy shall be notified for the year 2026-27 and shops shall be allotted accordingly. He assures that liquor Vends shall be strictly allotted in accordance with the prevailing Excise Policy. He further submits that in case there is any infraction, petitioner may make a representation which shall be considered in accordance with law.
3. Statement of learned Deputy Advocate General is taken on record and the writ petition is accordingly disposed of in terms of the said statement.
