JABALPUR, India, March 19 -- Madhya Pradesh High Court issued the following judgment/order on Feb. 13:

Petitioner has filed the subject petition seeking restoration of Writ Appeal No.796 of 2015, which was dismissed for want of prosecution on 02.03.2016.

Subject petition has been filed on 19.12.2025 with a delay of 3547 days. There is no explanation given in the application seeking condonation of delay. The application merely states that the reasons for delay have been explained in the petition seeking restoration however, even in the petition seeking restoration, there is no explanation for the gross delay of nearly 10 years.

It is contended that the appeal was filed and appellant being of old age could not contact his counsel thereafter, the brother of the appellant died and there was lockdown enforced in between March, 2020. After relaxation of lockdown, he could contact his counsel in December, 2025 and gathered information and cause to know that counsel is no longer practicing having been elevated to the Bench. There is no plausible explanation for the delay of 10 years.

We are not satisfied with the explanation given. There is no reason mentioned as to why the appellant was not vigilant about his rights. We are not inclined to condone the delay. The restoration application is accordingly, dismissed on the ground of delay and latches.
