RANCHI, India, Aug. 6 -- Jharkhand High Court issued the following order on July 9:
1. The petitioners are before this Court for direction to the respondents to pay adequate compensation from the date of dispossession of the petitioners from their Raiyati land under Khata Nos. 07, 10 and 17, Plot Nos. 4/582, 19 and 05, total area 93 decimals which has been taken over by the respondents for widening of road.
2. It is submitted by the learned counsel for the petitioners that there had been widening of road from Bariyardih to Markacho in the District of Koderma by the Rural Engineering Works Department, Government of Jharkhand and later on, the said work was taken over by Public Works Department, Jharkhand. In the said widening of road, the petitioners lost their lands, but no procedure under the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013 has been followed. In this regard, the petitioners submitted the representations before different Authorities which have been annexed as Annexure-4 Series, but no decision has been taken on the representations submitted by the petitioners.
3. In view of fact that no final decision has been taken, the petitioners are directed to submit their separate representation with details of land to the Deputy Commissioner, Koderma (respondent no. 3), who will dispose of the same after receipt of said representation, as per law.
Writ Petition stands disposed of. Interlocutory Application, if any, is disposed of.
