RANCHI, India, July 19 -- Jharkhand High Court issued the following order on Jun 18:
This anticipatory bail application under Section(s) 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Section(s) 406, 420, 467, 468, 471 and 120B IPC, in connection with Bermo P.S. Case No. 38/2024, pending in the Court of learned SDJM, Bermo at Tenughat.
Heard the parties at length and had gone through the documents, annexed along with this application.
Opportunity was given to the State to oppose the bail, which the State availed and opposed.
The allegation against this petitioner is that he impersonated himself as Jhagru Prajapati and by forging several documents had obtained loan in the name of Jhagru Prajapati from the Bank and purchased a vehicle, which he handed to the mafias.
Learned counsel for the petitioner submits that the petitioner is suffering from diseases as well as partial amenisia.
From the materials on record, I find that the petitioner has not only forged the signature rather he appears as Jhagru Prajapati, who he is not and obtained the loan and thereafter he purchased a vehicle, which was given to mafias.
In view of the aforesaid facts, I am not inclined to allow this anticipatory bail application. Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected.
