RANCHI, India, March 8 -- Jharkhand High Court issued the following order on Feb. 6:
1. Heard the parties.
2. The present writ petition has been filed for the following reliefs:-
i For Issuance of an appropriate writ/order/direction commanding the Respondents, particularly the authorities of Tata Steel Utilities and Infrastructure Services Limited (JUSCO) and Jharkhand Bijli Vitran Nigam Limited (JBVNL), to immediately disconnect the illegal water and electricity connections obtained by Respondent Nos. 5 and 6 in their names, which are operating without any valid authorization, ownership proof, or No Objection Certificate from the petitioner.
ii. For Issuance of an appropriate writ/order/direction commanding the Sub-Divisional Magistrate, Jamshedpur, to initiate necessary proceedings for identification, verification, and enquiry of the disputed property standing in the name of the petitioner and to remove the illegal occupation of Respondent Nos. 5 and 6, who have unauthorizedly occupied the petitioner's residential premises by initiating proper proceedings as per law.
iii. Direct the concerned authorities to take necessary steps for restoring possession of the disputed property to the petitioner and to ensure that no unauthorized use of the petitioner's premises is made by Respondent Nos. 5 and 6 or any other person claiming through them.
3. It appears that it is a family dispute between the parties and it cannot be resolved by taking loop line. It can be only resolved by the competent Civil Court.
4. In that view of the matter, this Court is not inclined to entertain the present writ petition.
5. Accordingly, the present writ petition stands disposed of giving liberty to the parties to work out their remedy in accordance with law.
