RANCHI, India, July 24 -- Jharkhand High Court issued the following order on June 24:
This anticipatory bail application under Section(s) 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest for offences registered under Section(s) 341, 323, 385, 386, 504, 506/34 IPC.
Heard the parties at length and had gone through the documents, annexed along with this application.
Opportunity was given to the State to oppose the bail, which the State availed and opposed.
It is alleged that this petition along with Sushil Kr. Soni had stopped the vehicle of the informant and demanded money by way of extortion.
Counsel for the petitioner submits that Sushil Kr. Soni is the brother of this petitioner and the said Sushil Kr. Soni lodged a complaint before the local police and an online FIR was filed much prior to the institution of this case alleging therein that this informant and others have kidnapped his father. Only by way of retaliation, the instant case has been lodged. He further submits that even the independent witnesses whose statements were recorded in para 41 and 42, have not stated that they have demanded any money from the informant by way of ransom. They stated that only the vehicle was stopped and some money was demanded for performing the Puja.
Considering the submission of the parties and the fact that said Sushil Kumar Soni having similar allegation has been granted anticipatory bail by a co-ordinate Bench of this Court in A.B.A No. 24/2025 and the said Sushil Kumar Soni has earlier lodged a case against the informant, I am inclined to allow this anticipatory bail application. Accordingly, the petitioner, above named, is directed to surrender before the court below within four weeks from today and in the event of his surrender/arrest, the court below is directed to enlarge him on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Latehar, in connection with Latehar P.S. Case No. 243 of 2023, subject to condition that one of the bailers should be close relative of the petitioner and other should be a resident of State of Jharkhand, having sufficient landed property in his/her name or in the name of his/her ancestors in which he/she is having share and to that effect, he/she has to file an affidavit before the Trial Court indicating his/her share in the property.
