RANCHI, India, May 29 -- Jharkhand High Court issued the following order on April 29:

1. Heard, the learned counsel for the petitioner, learned counsel for the State and learned counsel for the respondent.

2. It is the grievance of the petitioner that the entire amount of compensation assessed under the National Highways Act for acquisition of the ancestral land of these petitioners, were paid to the mothers of the petitioners and aunt of the petitioner No.2. The petitioners though have share in the same property, have not been paid any amount of compensation.

3. Learned counsel for the petitioners submit that the National Highways Act, 1956 being self-content Court provides for the appropriate remedies, which the petitioners have already availed by filing an application for reference under Section 3(H)(4) of the Act, but the respondents are sitting tight over the matter. He submits that suffice it would be if a direction is given to the District Land Acquisition Officer to pass an appropriate order on the representation of the petitioner and act accordingly.

4. Learned counsel appearing on behalf of the State and learned counsel for the respondent-National Highway Authority submits that if the matter is pending before the authority, an appropriate order will be passed.

5. Considering the said submission, I direct the petitioners to file a fresh representation along with a copy of this order before the District Land Acquisition Officer, Gumla, who after considering the same petition do the needful as per the Act and if it is necessary, he will refer the matter to the Civil Court in terms of the Act.

6. It is expected that the entire process should be concluded within a period of ten weeks from the date of receipt of a copy of this order.

7. With the aforesaid observation and direction, this writ petition stands disposed of.

8. Pending, I.A., if any, stands disposed of.
